The most frequently asked by apartment owners is how to avoid non-payers and thus prevent financial damage caused by non-payment of rent and service payments, as well as possible property damage. Je ťažké uveriť, že obrázky vľavo a vpravo zobrazujú ten istý byt. Na obrázku vľavo je byt pred začatím nájmu a na obrázku vpravo je byt v stave, v akom ho nájomníci vrátili. Nájomcovia spôsobili majiteľom bytov finančnú škodu (dlh na nájomnom) a tiež škodu na majetku (nájomcovia ukradli celé zariadenie bytu a na mieste nechali cudzie bezcenné a poškodené kusy nábytku). Bohužiaľ, tieto prípady sa stávajú pomerne často.

Kde sa stala chyba? Dalo sa tomu zabrániť? Odpoveď je jasná. Áno, dalo sa tomu zabrániť. Majitelia bytu (resp. správcovská spoločnosť, ktorá byt prenajímala v neprítomnosti vlastníkov) premeškali pred uzavretím nájomnej zmluvy jeden dôležitý krok – nepreverili budúceho nájomcu. Ak by to urobili, zistili by tieto skutočnosti:

výška nájomného prevyšovala príjem nájomníkov
nájomníci boli odkázaní na sociálne dávky a nemali preukázateľné finančné príjmy zo závislej alebo inej činnosti
nájomníci mali viacero záznamov v insolvenčných registroch z dôvodu viacerých exekúcií

The picture on the left shows the apartment before the start of the lease, and the pictures on the right show the apartment in the state in which the tenants returned it. The tenants caused financial damage to the apartment owners (rent debt) and also property damage (the tenants stole the entire equipment of the apartment and left other people’s worthless and damaged pieces of furniture on the spot). Unfortunately, these cases happen quite often.

Where did the error occur? Could it have been prevented? The answer is clear. Yes, it could have been prevented. The owners of the apartment (respectively, the management company that rented the apartment in the absence of the owners) missed one important step before concluding the rental agreement – they did not check the future tenant. If they did, they would find the following facts:

  • the amount of rent exceeded the income of the tenants
  • the tenants were dependent on social benefits and had no demonstrable financial income from dependent or other activities
  • the tenants had several entries in the insolvency registers due to several foreclosures
